Our neighbour is wanting (very forcefully) to build a roof terrace (extending their current balcony) onto the roof of our proposed extension. Our extension is permit-free and does not have the adequate foundation strengthening in place to take the weight of the neighbours proposed roof terrace.
My understanding from Gemeente Amsterdam was that a roof terrace cannot be built on top of a permit free extension and as the owner of the extension, we do not have to approve the roof terrace from the neighhbour. We do not want the roof terrace as the roof of the extension is planned to be a green roof – the neighhbour knows this already.
What are our rights and can we block the development of a roof terrace on our extension?
